These Terms of Use ("Terms") govern your access to and use of our website, mobile interfaces, and any related services, including home maintenance, repair, renovation, handyman, and property care services provided by HomeHNI in the United Arab Emirates. By accessing or using our website or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Important: These Terms contain disclaimers, limitations of liability, and a binding arbitration clause (for UAE residents) that affects your legal rights. Please read carefully.

1. Definitions

In these Terms, the following terms shall have the meanings set forth below:

"HomeHNI", "we", "us", "our" refers to HomeHNI brand, its owners, employees, contractors, and affiliates operating from the UAE.
"User", "you", "your" refers to any individual or entity accessing the website or using our services.
"Services" includes but is not limited to: plumbing, electrical work, AC repair and maintenance, painting, carpentry, tiling, handyman tasks, general home repairs, renovation works, and property maintenance.
"Technician" refers to any HomeHNI employee, subcontractor, or third-party service provider assigned to perform the requested service.
"Site" refers to https://homehni.ae/ and all associated subdomains.

2. Acceptance of Terms

By using the Site or booking any Service, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a company, property management firm, or another entity, you warrant that you have authority to bind that entity to these Terms. These Terms apply to all users, including visitors, customers, and technicians (in their capacity as service providers).

We may revise these Terms from time to time. The latest version will be posted on this page with an updated "Last modified" date. Your continued use of the Site or Services after changes constitute acceptance of the revised Terms.

3. Our Services & Booking Process

HomeHNI provides on-demand and scheduled home maintenance solutions across the UAE (primarily Dubai, Abu Dhabi, Sharjah, and Ajman, subject to technician availability).

Booking: You may request a service via our website contact form, phone, WhatsApp, or email. Once you provide your details (name, address, service description, preferred time), we will send a confirmation along with a preliminary quote or estimated cost.
Quotes & Estimates: Any quote provided prior to inspection is an estimate based on the information you share. Final pricing may change after physical inspection if hidden damage, additional materials, or extra labor is required. We will notify you of any price change before proceeding.
Cancellation: You may cancel a booking free of charge at least 2 hours before the scheduled appointment. Cancellations within 2 hours or no-shows may incur a cancellation fee of AED 75–150 (depending on service type) to compensate for technician dispatch and time.
Emergency Services: For urgent issues (e.g., major water leaks, electrical hazards), we aim to respond within 2–4 hours. Emergency service rates may differ from standard pricing; this will be disclosed at booking.

4. Pricing, Payments & Taxes

All prices displayed on our website or provided in quotes are in United Arab Emirates Dirham (AED) and exclude Value Added Tax (VAT) unless stated otherwise. The current UAE VAT rate (5%) will be added where applicable.

Payment methods: We accept cash, bank transfer, credit/debit cards (via secure payment link), and select digital wallets. Payment is due upon completion of the service unless otherwise agreed in writing.
Deposits: For large projects (e.g., renovation, painting, extensive repairs) exceeding AED 2,000, we may require a deposit of 30%–50% before starting work. Deposits are non-refundable if you cancel after materials have been purchased or work has commenced.
Late payments: Outstanding invoices beyond 14 days may accrue a late fee of 2% per month or the maximum permitted by UAE law. Collection costs may be added.

5. User Obligations & Conduct

When using our Site or Services, you agree not to:

Provide false, inaccurate, or misleading information (including address, contact details, or property access).
Interfere with our technicians' ability to perform work (e.g., unsafe environment, aggressive behavior, refusal to provide necessary access).
Use our Site to transmit malware, spam, or any harmful code.
Reverse engineer, copy, or scrape any content from homehni.ae without written permission.
Request services that are illegal, hazardous, or violate any UAE law or regulation.

You are responsible for securing any necessary permissions from landlords, building management, or homeowners' associations before authorizing work. HomeHNI is not liable for third-party disputes arising from unauthorized repairs.

6. Technician Arrival, Access & Safety

You agree to provide a safe working environment and clear access to the areas where Services will be performed. If our technician determines that conditions are unsafe (e.g., exposed live wires, structural instability, aggressive pets, biohazards), we reserve the right to pause or cancel the service. A trip fee of AED 100 may apply in such cases.

If you are not present at the property at the scheduled time but have given prior consent for the technician to enter (e.g., via key handover or building security), you assume responsibility for any loss or damage that occurs during the service, except for gross negligence by HomeHNI.

7. Warranties & Disclaimers

HomeHNI warrants that all services will be performed with reasonable skill and care, consistent with industry standards in the UAE. We offer a 30-day workmanship warranty on most repairs (parts may have separate manufacturer warranties). If a defect arises due to faulty installation within 30 days, we will remedy it at no additional labor cost. This warranty does not cover:

Normal wear and tear, misuse, or damage caused by you or third parties after service completion.
Pre-existing issues not disclosed or discovered during the service.
Consumable items (e.g., light bulbs, seals, filters) unless defective upon installation.

To the maximum extent permitted by UAE law, HomeHNI disclaims all other warranties, express or implied, including merchantability or fitness for a particular purpose. Our Site and Services are provided "as is" and "as available".

8. Limitation of Liability

To the fullest extent permitted by applicable law, HomeHNI and its directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

Use or inability to use our Site or Services.
Any conduct or content of any third party (including subcontractors).
Unauthorized access to or alteration of your transmissions or data.
Any interruption or cessation of services related to our website.

Our total aggregate liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid to HomeHNI for the specific service giving rise to the claim, or AED 1,000 (whichever is lower). This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability).

Note: Some jurisdictions (including UAE) may not allow the exclusion of certain warranties or limitation of liability for death or personal injury resulting from gross negligence. In such cases, our liability shall be limited to the fullest extent permitted by UAE Federal laws.

9. Indemnification

You agree to indemnify, defend, and hold harmless HomeHNI, its affiliates, technicians, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your violation of these Terms or any applicable UAE law.
Your use of our Services in a manner not reasonably intended.
Any dispute between you and a third party (e.g., landlord, neighbor) regarding our work.
Your failure to provide accurate property access or safe working conditions.

10. Intellectual Property

All content on the HomeHNI website – including text, graphics, logos, images, videos, service marks, and software – is the exclusive property of HomeHNI or its licensors and is protected by UAE copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. You are granted a limited, revocable, non-exclusive license to access and view the Site for personal, non-commercial use.

11. Third-Party Links & Materials

Our Site may contain links to third-party websites (e.g., suppliers, payment gateways). HomeHNI does not endorse or assume responsibility for any third-party content, privacy policies, or practices. You access such links at your own risk.

12. Termination & Suspension

We may suspend or terminate your access to the Site or Services immediately, without prior notice, for any reason including breach of these Terms, fraudulent activity, or non-payment. Upon termination, all provisions that by their nature should survive (e.g., indemnification, limitation of liability, governing law) shall remain in effect.

13. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the United Arab Emirates, and the applicable laws of the Emirate of Dubai, without regard to conflict of law principles.

Informal Resolution: Before initiating any legal proceeding, you agree to contact us at contact@homehni.com to attempt an amicable resolution for at least 30 days.

Arbitration: Any dispute that cannot be resolved informally shall be finally settled by binding arbitration in Dubai, UAE, in accordance with the Dubai International Arbitration Centre (DIAC) rules. The arbitration shall be conducted in English. Judgment on the award may be entered in any court having jurisdiction. You waive the right to participate in a class action or class-wide arbitration.

Small claims exception: Claims under AED 10,000 may be brought in the courts of the UAE at your option, subject to mandatory consumer protections.

14. Force Majeure

HomeHNI shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to natural disasters, war, civil unrest, government actions, pandemics, utility failures, or supplier delays.

15. Entire Agreement & Severability

These Terms constitute the entire agreement between you and HomeHNI regarding the use of our Site and Services, superseding any prior agreements. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
